Availability
AAC Tools stocks all items listed to the best of our ability, but we are not liable for jobsite delays due to items that are not in stock. Some items may take weeks to ship from Europe. It is the general contractor's responsibility to make sure that equipment, tools and fasteners are available in a timely manner.
Payment
All orders shall be paid in advance unless prior approval is granted. Acceptable forms of payment include cash, check, wire transfer, Visa and Mastercard. A 3% surcharge may be applied to equipment rentals or purchases charged on credit cards.
Sales Tax
Any items shipped to customers in Georgia will be charged Georgia sales tax unless a valid copy of a Georgia Sales Tax Exemption form is provided. Customers outside Georgia are responsible to pay any applicable sales tax.
Deposit
A deposit shall be required on all rental equipment, the amount of which is determined by AAC Tools. The deposit is refundable if all the tenants are the contract are met. The deposit may be used to cover repair costs in the event of damage or wear to the machine. It shall not be considered an insurance policy as it may be insufficient to cover the costs of damage, wear, or replacement. Renter agrees to pay all such cost, and is advised to purchase an insurance policy to cover the equipment during the rental period and in shipping back to AAC Tools.
Rental Rates
All rental rates are listed on the invoice. Months go from date of rental to same date of next month. Weeks go from day of week to same day of next week. If Renter exceeds initial estimated time of rental, then billing shall be applied at given rates. Rental equipment shall be paid for monthly, if not entirely in advance. Failure to pay by renewal date could result in forfeiture of deposit. Renter is responsible for any expenses incurred during retrieval of equipment due to delinquent accounts, including but not limited to transportation and lodging expenses and legal fees.
Delivery Times
Delivery times are not guaranteed. AAC Tools is not responsible for project delays related to delivery.
Rental Equipment Delivery
All costs for both delivery and return of rented equipment shall be the responsibility of the Renter. This shall generally be paid in advance, but in the event that it is not or if the amount changes, the costs shall be taken out of the deposit. The Renter acknowledges full responsibility for any return costs that exceed the remaining deposit and agrees to pay AAC Tools in full.
Location of Rental Equipment
Rental equipment may not be moved from the jobsite to another location without permission and knowledge of AAC Tools.
Storage Fees
All items purchased from AAC Tools but not picked up or delivered may be subject to a storage fee. This could happen if you wanted to purchase an item because of its limited availability, then waited for an extended period to combine shipping with other items. If you desire AAC Tools to store equipment for you, then arrangements must be made prior to purchase.
Shipping Damage
AAC Tools is not responsible for damage which occurs during shipping unless the customer asks for and pays additionally for shipping insurance. In the event that there is damage, it is the customer's responsibility to note it on the shipping receipt and to take photographs of the damaged goods still in the box.
Damage to Rental Equipment
Rental equipment shall be supplied in good working order with all safety devices working properly. Rental equipment will be insured and if it arrives damaged the customer must note it on the shipping receipt and take pictuers of it still on the pallet. AAC Tools will repair or replace the damaged equipment at its discretion.
Repairs to Rental Equipment
Rental equipment belongs to AAC Tools and only AAC Tools may authorize repairs on the equipment. No unauthorized repairs performed on the rental equipment will be reimbursed to Renter, and Renter may be charged to restore the equipment to its original configuration. Rented equipment may be in used condition, but will be supplied fully operational. Any cosmetic or functional issues which occur during rental shall be the full responsibility of the Renter. If Renter experiences any problems with rented equipment, Renter should contact AAC Tools immediately to seek counsel as to how to proceed. Most AAC equipment is specialized and imported from Europe. We have experience working on said equipment and carry many specialized spare parts in stock. Renter is responsible for cost of repairs for damage incurred during the rental period and in return transit.
Returns
AAC Tools does not solicit sales. If you ordered something from us, then you must have wanted it for some reason. Do not order something if you do not want or need it. There are no refunds. If something is damaged or defective, it will be repaired or replaced at the discretion of AAC Tools. We are not responsible for project or funding changes that alter your equipment needs after order placement. Customer agrees to take delivery of equipment ordered.
Buy-Back Policy
AAC Tools may offer to buy back used AAC equipment, but this is by no means an obligation. The price offered will be determined by AAC Tools.
Rent-to-Own
AAC Tools offers a rent-to-own plan on most rental equipment. In this arrangement, the first month's rent does not apply toward the purchase price, but all subsequent rent and deposits shall be applied to the purchase price. Delivery costs on equipment do not apply toward the purchase price.
Storage
All items purchased from AAC Tools but not picked up or delivered may be subject to a storage fee. If you desire AAC Tools to store equipment for you, then arrangements must be made prior to purchase.
Safety
AAC Tools customers of both rental and purchased equipment acknowledge that use of construction equipment can be dangerous, even if used in a safe manner. Rental and new equipment shall be supplied with all safety guards and devices properly installed and functioning. It is the sole responsibility of the Customer to make sure the equipment is used in a safe manner. If Customer is unfamiliar with rented or purchased equipment or needs assistance learning to operate it, it is the Customer's responsibility to contact AAC Tools for instructions. AAC Tools accepts no liability whatsoever for any injury or damage caused by use of rented or purchased equipment. Renter is responsible for equipment the entire time it is under rental contract and until it has been picked up or returned to AAC Tools. Rental is responsible for insuring equipment while it is in Renter's possession and in return transit. Theft, vandalism, fire damage, transport damage and all other damage to rental equipment are the responsibility of Renter. AAC Tools is not responsible for any loss of time, income or any other expense incurred due to equipment failure or misuse.
Construction Advice
The installation guides and other information provided by AAC Tools and any advice given via telephone/e-mail or in person are offered as a courtesy and for general information guidelines for AAC construction and are not warranted to be in complicance with your local building codes. It is not the responsibility of AAC Tools to provide structural engineering for your project. It is the responsibility of the general contractor to make sure that the AAC construction meets all applicable building guidelines.
Used Equipment
On occasion AAC Tools may offer used equipment for sale. Used equipment is sold as-is with no warranty and no return. Customer is responsible for determining functionality, safety and value of equipment prior to purchase.
